Terms of Service

By using thesummitstr.com or any Summit Short Term Rentals product (the "Services") — the marketing site, the AI Property Analyzer, contact forms, newsletter, and Owner Portal — you agree to these Terms. If you don't agree, please don't use the Services.

Property-management engagements between you and Summit STR LLC are governed by a separately executed Management Agreement, not by these Terms. In case of conflict between these Terms and a signed Management Agreement, the Management Agreement controls.

The AI Property Analyzer provides a directional revenue estimate generated from the listing content or address you submit. It is an aid for planning and comparison, not a guarantee of future revenue, occupancy, or investment performance. Actual results depend on the specific property, market conditions, seasonality, guest behavior, and factors outside our control. Do not rely on the estimate as the sole basis for a purchase, sale, financing, or investment decision. If your property is inside our service footprint, request a comp-backed human review by scheduling a consult.

You agree not to:

• Submit listings for properties you don't own or aren't authorized to represent.
• Attempt to scrape, reverse-engineer, or overload the analyzer or other Services.
• Use the Services to violate any law or the terms of a third-party platform (for example, Airbnb, VRBO).
• Impersonate any person or misrepresent your identity or authority.

Owner Portal access is granted by invitation. You are responsible for keeping your credentials secure and for all activity that occurs under your account. Notify us promptly at hello@summitstr.co if you suspect unauthorized access.

The Services, including text, graphics, code, layouts, and analyzer output, are owned by Summit STR LLC or its licensors and are protected by U.S. copyright and other laws. You may share individual pages via link but may not reproduce, redistribute, or commercially exploit content without our written permission.

Some Services rely on third-party platforms (for example, Airbnb, VRBO, Hospitable, PriceLabs, Stripe, and mapping providers). We're not responsible for third-party outages, errors, or policy changes. Their terms and privacy notices govern your use of their services.

The Services are provided "as is" and "as available." To the fullest extent permitted by law, Summit disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranty that the Services will be uninterrupted, error-free, or produce specific results.

To the fullest extent permitted by law, Summit and its owners, officers, employees, and contractors will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or lost data, arising from or related to your use of the Services. In no event will our aggregate liability arising from these Terms exceed one hundred U.S. dollars (US$100). This limitation doesn't apply to fraud, willful misconduct, or liability that can't be limited under applicable law. Nothing in these Terms limits any obligation Summit has under a separately signed Management Agreement.

You agree to defend and indemnify Summit against claims arising from your misuse of the Services, your violation of these Terms, or your violation of any third party's rights.

These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-law rules. Exclusive venue for any dispute is the state and federal courts located in El Paso County, Colorado.

We may update these Terms from time to time. The "Last updated" date at the top of the page reflects when the most recent change took effect. Continued use of the Services after a change constitutes acceptance of the revised Terms.
